Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Localish ("Localish", "we", "us") at https://localish.online and any related applications or services we provide.

By accessing Localish, creating an account, or using any part of the service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Localish.

Localish is operated by YesNow OÜ (registry code 16506641), Pärnu mnt 139b, 11317 Tallinn, Estonia.

2. The service

Localish is a marketplace for curated local travel lists. Locals publish collections of places and experiences; travellers browse, favorite, rate, comment on, and may unlock premium lists.

We may update, improve, or discontinue features at any time. Some features, including paid checkout and local payouts, may be marked as coming soon or unavailable in your region.

3. Accounts and eligibility

You must be at least 16 years old to create an account and use Localish as a traveller. To become a local (Creator) you must be at least 18 years old. You are responsible for the activity that occurs under your account and for keeping your login credentials secure.

You may create an account with email and password or sign in with Google. Information received through Google Sign-In is used to create or update your Localish profile, as described in our Privacy Policy.

If you apply to become a local, you agree to provide accurate information about your connection to the destination and your ability to create trustworthy recommendations. We may approve or reject applications at our discretion. Locals who publish lists are also bound by the Creator Terms & Conditions, which you must expressly accept before applying or publishing.

You may not impersonate another person, use another person's account without permission, or create accounts through automated means.

4. Your content

You retain ownership of content you submit to Localish, including collections, experiences, images, comments, and profile information ("User Content").

By submitting User Content, you grant Localish a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and otherwise use that content as needed to operate, promote, and improve the service. This license ends when your content is deleted from our systems, except where retention is required by law or legitimate backup practices.

You represent that you have the rights needed to submit your User Content and that it does not violate law or third-party rights.

We may remove or restrict content that violates these Terms, appears misleading, infringes rights, or harms the community. If you believe content on Localish infringes your rights, contact us at info@localish.xyz.

5. Purchases and payouts

Some collections may be offered for free; others may require payment to unlock. When paid checkout is available, prices will be shown before purchase and payments will be processed by a third-party payment provider.

Paid checkout is not fully live at the time these Terms were last updated. When it becomes available, additional payment terms and refund rules may apply and will be presented at checkout.

Locals who sell premium lists may be subject to a platform fee. The applicable split, payout rules, and other Creator-specific terms are set out in the Creator Terms & Conditions.

You are responsible for any taxes applicable to your purchases or earnings, where required by law.

6. Acceptable use

You agree not to:

• Use Localish for unlawful, fraudulent, or harmful purposes
• Post false, misleading, or defamatory recommendations or profile information
• Harass, abuse, or threaten other users
• Scrape, crawl, or reverse engineer the service except as permitted by law
• Interfere with security features or attempt unauthorized access to accounts or systems
• Upload malware or content that contains viruses or harmful code
• Use Localish to send spam or unsolicited promotional messages

7. Suspension and termination

You may stop using Localish at any time. You may request account deletion by contacting info@localish.xyz.

We may suspend or terminate your access if you violate these Terms, create risk for other users, or if we are required to do so by law. We may also discontinue the service in whole or in part.

Sections that by their nature should survive termination will continue to apply, including content licenses granted for content already distributed, disclaimers, and limitations of liability.

8. Disclaimers

Localish provides travel recommendations created by independent locals. We do not guarantee that any place, experience, price, opening hour, or safety condition is accurate, available, or suitable for you.

Links to third-party services, including Google Maps, are provided for convenience. We do not control and are not responsible for third-party websites or services.

The service is provided on an "as is" and "as available" basis to the fullest extent permitted by applicable law.

9. Limitation of liability

To the extent permitted by applicable law, Localish and its operator are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of the service.

Where liability cannot be excluded under mandatory law, our total liability for claims relating to the service is limited to the greater of (a) the amount you paid to Localish in the twelve months before the event giving rise to the claim, or (b) EUR 100.

Nothing in these Terms limits liability for intent, gross negligence, injury to life, body, or health, or any liability that cannot be limited under Estonian law.

10. Governing law

These Terms are governed by the laws of Estonia, excluding conflict of law rules. If you are a consumer resident in the European Union, you retain mandatory protections of the laws of your country of residence.

If you are a merchant, the courts of Estonia have exclusive jurisdiction for disputes arising from these Terms, unless mandatory law provides otherwise.

11. Changes

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the effective date. Continued use after changes become effective constitutes acceptance of the updated Terms.
